Recruitment Privacy Statement
This Privacy Statement gives you information about the Personal Data we collect about you in relation to your application for employment with Huawei and how and why we use that Personal Data in the course of our recruitment processes. Huawei recruitment systems are used globally by Huawei (“we", "us", and "our") to perform recruitment activities. "Huawei" refers to Huawei Investment & Holding Co., Ltd. and all wholly-owned subsidiaries directly or indirectly controlled by it, but excludes joint venture companies. The aim of this is to offer job opportunities to applicants around the world. The Personal Data you submit to our recruitment systems will only be used for recruitment and hiring. We understand how important your privacy is to you and are fully committed to protecting your Personal Data worldwide in accordance with all applicable data protection laws and regulations.
Please read carefully and fully understand the Huawei Recruitment Privacy Statement (the "Statement") before submitting your Personal Data to us.

Please note that the Statement only applies to Huawei recruitment systems, and can be referred to on smartphones, tablets, computer applications, tools, software, websites, or services.
The Statement describes how we process your Personal Data and confirms our commitment to protecting your privacy. However, the Statement may not address all possible data processing scenarios. We will release supplementary policies on how product- or service-specific data is collected. In cases of ambiguities, such supplementary policies shall prevail over this Statement. We encourage you to read the Statement and any related supplementary information to fully understand Huawei's privacy policies for specific products or services.
The provision of the Personal Data is necessary in order to process your job application. If you do not provide your Personal Data, it might be possible that we cannot process your application.
The identity and contact details of the Controllers
Huawei Technologies Dusseldorf GmbH (our West Europe Region headquarter), registered address Hansaallee 205, 40549 Duesseldorf, Germany, telephone number: 0211 88254 1100 is a Personal Data Controller. This means that we are responsible for deciding how we hold and use Personal Data about you.
Huawei Technologies Co. Ltd. (our Chinese parent company), registered address Huawei Base, Bantian, Longgang District, Shenzhen, China.
Depending on the location of the job that you apply for, please also refer to the listing of Controllers as per legal entity outlined under section 12.
In connection with your application, we may collect, use and store Personal Data including your name, profile picture, phone number, email address, work experience, and skills. Personal Data refers to any information that can be used to identify an individual, either on its own or when combined with other pieces of information.The types of Personal Data we collect include:
1.1 Data you give us:
To participate in recruitment, you might need to create a Huawei account or profile. When you do, we will ask for account information, such as your email address and telephone number. The data you give us directly includes all data provided in your resume and other Personal Data that we collect for the purpose of recruitment. This data can include your name, gender, address, postal code, contact information, date of birth, internal identity number, work experience, skills, qualifications, certificates, academic degree, professional titles, and other information you provide us during interviews or that is required for a specific vacancy.
1.2 Data from third parties:
We may obtain data about you from publicly and commercially available sources as permitted by law. We may also collect data about you through third-party social networking services when you do things such as logging in to our websites using your Facebook, LinkedIn or Twitter account, etc. Candidate Data may also be obtained from recruitment agencies or headhunting firms or from other Huawei employees or workers who recommend people they know for employment with Huawei.
We collect and use your Personal Data for the purpose of recruitment, including:
· Identifying and contacting potential Candidates;
· Evaluating Candidates for potential employment by assessing the competency and suitability of Candidates applying for employment with Huawei;
· Keeping records relating to recruitment;
· Providing you with more suitable career opportunities at Huawei;
· Identifying Candidates for future positions that may become available.
· Making hiring decisions on whether or not to offer employment to any particular Candidate
· Deciding the terms and conditions of any such offer
· Having evidence in case a legal claim is pursued by any Candidate
· Complying with legal or regulatory requirements
· Scientific research and statistical purposes
· Maintaining a talent pool in order to contact potential Candidates with regard to future job openings even if an actual application was unsuccessful.
Special Provision for Spain:
Please note that if you apply for a job located in Spain, we will process your Personal Data based on your consent (Art. 6 para. 1 lit. a GDPR).
All other Cases:
In all other cases, the following shall apply:
We process the Personal Data of Candidates for the purposes of the employment relationship, in particular for the decision on the establishment of the employment relationship (Art. 6 para. 1 lit. b GDPR). It is also in Huawei’s legitimate interests (Art. 6 para. 1 lit. f GDPR) to process the Personal Data in order to ensure that the best suited Candidate with the required skills, qualifications and experience is offered employment and to fulfill precontractual obligations.
In order to verify the work history of the Candidate and assess their suitability for employment, we conduct referencing and, in particular cases, other background checks (Art. 6 para. 1 lit. b and f GDPR). In some cases, we may ask the Candidate’s consent (Art. 6 para. 1 lit. a GDPR) before conducting such background checks; however, we reserve to rely on additional legal grounds for the processing within the context of such background checks even if the Candidate refuses or revokes their consent. The information is collected directly from the Candidate and from third parties such as former employers. We use a third party supplier who provides us with the outcome of the Background Checks (not the underlying data they have collected in the course of the checks). The outcome report is strictly limited to those individuals within Huawei who are involved in the recruitment and selection process and other individuals specified in our Background Checks Policy.
Where we process Personal Data for the purpose of complying with legal or statutory requirements, this is based on Art. 6 para. 1 lit. c GDPR.
The processing for scientific research and statistical purposes is based on Art. 89 GDPR in connection with the specific safeguards and derogations in accordance with the GDPR.
The maintaining of a talent pool in order to contact potential Candidates with regard to future job openings even if an actual application was unsuccessful will be based on the Candidate’s consent (Art. 6 para. 1 lit. a GDPR).
If you apply through our website, we may at times place a small piece of data known as a cookie on your computer or mobile device to ensure our website works correctly. Such processing shall be based on our legitimate interest to provide you with a functioning website (Art. 6 para. 1 lit. f GDPR). A cookie is a text file stored by a web server on a computer or mobile device. The content of a cookie can be retrieved or read only by the server that creates the cookie. The text in a cookie often consists of identifiers, site names, and some numbers and characters. Cookies are unique to the browsers or mobile applications you use, and enable websites to store data such as your preferences or items in your shopping cart.
In addition to cookies, we may also use other similar technologies on our websites such as web beacons and pixel tags. For example, when you receive an email from Huawei, it may contain a click-through URL that links to a Huawei web page. If you click the link, Huawei will track your visit to help us learn about your preferences for products and services and improve our customer service. A web beacon is a transparent graphic image embedded in a website or in an email. We use pixel tags in emails to find out whether an email has been opened. You can unsubscribe from the Huawei mailing list at any time if you do not want to be tracked in this manner.
Many web browsers have a Do Not Track feature, which issues Do Not Track requests to websites. Currently, the main Internet standards organization has no policy to govern how websites should respond to such requests. However, all Huawei websites do respect the Do Not Track option if it is enabled in your browser.
5.1 Huawei is a world-wide group of companies, which operates not necessarily along the borders of legal entities and countries, but according to functions which may exist across various group companies and countries. Like most global organizations, Huawei has centralized data management systems in place which involve Personal Data being accessible by Huawei group companies outside of the European Economic Area. The processing by other companies of the Huawei group will be based on Huawei’s legitimate interest to process Personal Data within a group of undertakings for internal administrative purposes (Art. 6 para. 1 lit. f GDPR). In particular, we have recruitment, HR and IT management systems which are hosted by our parent company (Huawei Technologies Co. Ltd.) in China. This means that all Personal Data which are held on these systems (including emails) and other applications and platforms may be accessible by employees of Huawei Technologies Co. Ltd. Please also refer to section 9 for more information on international data transfer.
5.2 Human Resources, Recruitment team members and managers/other employees within Huawei who are involved in the recruitment and selection process and general HR management of the successful Candidate may have access to your data provided.
Furthermore, recruitment agencies and headhunter firms receive feedback from Huawei in relation to the assessment of the Candidates they have recommended and the terms and conditions of employment to be offered to any Candidate they have recommended. In this case, the processing is based on the purpose of the Candidate’s agreement with the recruitment agency or headhunter firm and on our and the recruitment agency’s/headhunter firm’s legitimate interest to process such data for the purpose of determining and settling a potential referral fee (Art. 6 para. 1 lit. b and f GDPR).
You should ensure that all Personal Data you submit is accurate and complete. If you are unable to provide accurate and complete information for any reason or are unwilling to submit the Personal Data required for a specific position, our recruitment department may be unable to deem you fit for a specific job.
In accordance with applicable laws and policies, and regardless of the above tools and mechanism for managing your Personal Data, you have the following rights:
Right of access (Art. 15 GDPR)
You can request a confirmation as to whether or not personal data about you is processed and you can, where applicable, receive a copy of personal data we process about you.
Right of portability (Art. 20 GDPR)
You can receive certain data that you have provided to us in a machine-readable format under certain requirements.
Right of erasure (‘right to be forgotten’) (Art. 17 GDPR)
You can have your data erased under certain conditions.
Right of rectification (Art. 16 GDPR)
You can have your inaccurate data corrected and incomplete data completed.
Withdraw consent (Art. 7 para. 3 GDPR)
You can withdraw a consent to the processing of Personal Data you have given us.
Right to object (Art. 21 GDPR)
You can object to processing of your data to certain purposes such as direct marketing.
Right to restrict processing (art. 18 GDPR)
You can require us to restrict processing of your personal data under certain conditions.
Before we accede to such a request, we may need to verify your identity. To ensure security, you may be asked to submit a written request. You also have the right to delete or amend any personal information about you that we hold. We always ensure we will promptly respond to such requests. To make such a request, please click here . We may decline to process or limit certain requests under certain circumstances, e. g. if they are manifestly unfounded or excessive or if they adversely affect the rights and freedoms of others.
We aim to take all reasonable organizational and technical measures to protect your Personal Data from unauthorized access, disclosure, use, modification, damage or loss. We will continue improving these measures to protect the security of your Personal Data. For example, we use encryptions to ensure data confidentiality; we use trusted protection mechanisms to protect data from malicious attacks; we deploy access control mechanisms to ensure only authorized personnel can access Personal Data; and we raise awareness among employees about the importance of protecting Personal Data through security and privacy protection training sessions.
Unless otherwise required or permitted by laws and regulations, we endeavor not to retain your Personal Data for longer than it takes to complete the recruitment process. If you are hired, your Personal Data will be stored in our human resource system, and you will be informed in a separate privacy notice about the specifics on how we process Personal Data of our employees. If you are not hired, your Personal Data will be deleted after the reasonable retention period according to local practice according to the job location as outlined below:
· Belgium, Netherlands, Luxembourg: 1 year
· Germany: 4 months
· France, Spain, Portugal, Switzerland: 2 years
· Ireland / UK: 6 months
· Italy: 3 years
Besides the above, Candidates, will be contacted regularly via email, to give their consent to remain in our Global Huawei Talent Pool. If the consent is not actively given, the Personal Data will no longer be retained, unless otherwise required or permitted by laws and regulations.
We may share your data with the recruitment departments of our affiliates or our human resource consultants, who will contact you regarding recruitment. Other jurisdictions outside the European Union or the European Economic Area may have different or no data protection laws. If your Personal Data are processed by us or the aforementioned outside the European Union or the European Economic Area (so-called third countries), we have taken suitable measures to ensure that in the event that your Personal Data is transmitted to third countries and processed by the respective recipient an appropriate level of data protection is guaranteed, in particular by adopting the standard data protection clauses adopted by the Commission. Huawei reserves the right to update or change this Policy at any time. We will keep the Policy up to date with any changes.

Huawei respects third parties' intellectual property, trade secrets and other legitimate rights and interests, and protects its own intellectual property and trade secrets. When a candidate is applying for a position at Huawei, Huawei rejects, does not need, and will not accept any disclosure of intellectual property or trade secrets belonging to the candidate's current or former employer(s). This applies to both, before and after a candidate is hired by Huawei. The candidate is fully aware of Huawei's policies regarding intellectual property and trade secrets, and hereby agrees that:
1. The candidate shall not disclose any confidential information to Huawei, especially information that is related to any secrets (e.g., trade secrets and military secrets) or intellectual property of the candidate’s current or former employer(s), or any other third party.
2. In the event of any questions relating to the candidate’s duty of confidentiality towards his/her current or former employer(s), or any other third party, the candidate has the right to refuse to answer these questions, stating that doing so would breach his/ her duty of confidentiality.
3. In the event that the candidate breaches the terms of this Commitment Huawei reserves the right to end his/her candidacy for a Huawei position, and withdraw any offer of employment made to the candidate.
